This section delineates the procedures for implementing Locatwork's Terms of Conditions and the repercussions for breaches of the rules.
Suspension and Termination of Accounts: In the event of a violation of these regulations, Locatwork retains the right to suspend user accounts and limit access to Locatwork services.
Authority to Investigate and Take Action: Locatwork possesses the authority to investigate potential breaches of the Terms of Condition and may opt to temporarily halt, modify, or remove content from the site as necessary. While Locatwork does not assure action for every violation, the absence of action in one instance does not forfeit the right to take action in the future, whether related to the initial breach or not.
Account Disabling: If a breach is suspected, Locatwork may suspend a user's access to the site at any time. In the event of account disabling or closure, specific provisions will persist, including Locatwork's rights to utilize and share user feedback, users' and visitors' rights to share content, and the user's ongoing commitment.
This section encourages users to report any observed breaches of the Terms of Condition and outlines the reporting process.
Reporting Mechanism: Users are urged to notify Locatwork's customer service team or utilize the designated reporting feature when encountering potential violations.
User Cooperation in Investigations: Upon Locatwork's follow-up on reported breaches, users are expected to cooperate with investigations and take reasonable steps to facilitate problem resolution.
In the event of any dispute, confusion, or difference arising from, out of, or in connection with the terms outlined in the Terms and Conditions (referred to hereafter as the "Dispute"), both Locatwork and You (hereinafter collectively referred to as the "Parties") shall make reasonable efforts to amicably resolve such Dispute through mediation promptly.
If all attempts at resolution through mediation prove unsuccessful, the Parties shall resort to arbitration as the final and binding method for dispute resolution. The selection of arbitrators shall be a joint decision, to be made within a period of two months.
The arbitration proceedings shall be conducted in the English language.
The arbitration hearings concerning the provisions of this clause shall take place in the court of _______________.
Unless otherwise specified in the arbitral award, both Parties shall share equally the costs associated with arbitration, inclusive of arbitrators' fees.
The Awards and Proceedings shall be conducted in accordance with the provisions of the relevant legislation.
The award rendered jointly by the arbitrators shall be deemed final, bringing a conclusive resolution to the Dispute.
